Legal Validity of Wills
A Will created using ezyWill can be legally valid in all Australian states and territories, provided it is properly executed. For a Will to be valid, it generally must:
- Be made by a person over 18 years of age (with limited exceptions)
- Be made voluntarily without undue influence
- Be made by a person of sound mind (testamentary capacity)
- Be in writing
- Be signed by the Will-maker in the presence of two independent witnesses
- Be signed by both witnesses in the presence of the Will-maker
Witnesses must be over 18, of sound mind, and must not be beneficiaries under the Will or spouses of beneficiaries. Failing to meet these requirements may render your Will invalid.
Your Responsibilities
When using ezyWill, you are responsible for:
- Providing accurate and complete information
- Reviewing your completed Will carefully before signing
- Properly executing (signing and witnessing) your Will
- Storing your original Will safely
- Updating your Will when circumstances change
- Informing your executor of the Will's location
- Seeking legal advice if you have any doubts or complex circumstances
Limitation of Liability
To the maximum extent permitted by law, ezyWill Pty Ltd, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:
