Legal Validity of Wills

A Will created using ezyWill can be legally valid in all Australian states and territories, provided it is properly executed. For a Will to be valid, it generally must:

• Be made by a person over 18 years of age (with limited exceptions)
• Be made voluntarily without undue influence
• Be made by a person of sound mind (testamentary capacity)
• Be in writing
• Be signed by the Will-maker in the presence of two independent witnesses
• Be signed by both witnesses in the presence of the Will-maker

Witnesses must be over 18, of sound mind, and must not be beneficiaries under the Will or spouses of beneficiaries. Failing to meet these requirements may render your Will invalid.

Your Responsibilities

When using ezyWill, you are responsible for:

• Properly executing (signing and witnessing) your Will
